Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and PulseTerminal (pulseterminal.space) (“Company,” “we,” “us,” or “our”), the operator of PulseTerminal, accessible at pulseterminal.space (the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Platform.

1. Service Description

PulseTerminal is a cryptocurrency market analytics and observation platform. The Platform provides real-time and historical market data visualization, correlation analysis between digital assets, short-term probabilistic price forecasting, portfolio observation tools, and configurable alert systems. The Platform aggregates publicly available data from exchanges, on-chain sources, and market data providers to present analytical views of the cryptocurrency market.

PulseTerminal does not provide financial advice, investment recommendations, or trading signals. All forecasts, analytics, and data presented on the Platform are for informational and educational purposes only. The Platform is a market observation tool, not a financial advisory service. You should consult a qualified financial advisor before making any investment decisions.

2. Account Registration

To access certain features of the Platform, you must create an account. When registering, you agree to provide accurate, current, and complete information and to keep your account credentials secure. You are solely responsible for all activity that occurs under your account. You must be at least 18 years of age (or the age of majority in your jurisdiction) to create an account. We reserve the right to suspend or terminate accounts that contain inaccurate information or are used in violation of these Terms.

You may not create multiple accounts for the purpose of circumventing usage limits, abusing trial periods, or any other purpose that violates these Terms. You may not share your account credentials with third parties or allow others to access the Platform using your account.

3. Free Trial and Subscriptions

PulseTerminal offers a free public tier with limited functionality. Paid subscription plans (“Pro,” “Premium,” and “Teams”) provide access to additional features as described on the pricing page. Each new paid subscription begins with a 14-day free trial period, during which you may access all features of your selected plan at no charge.

At the end of the trial period, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription fee unless you cancel before the trial period ends. Subscription fees are billed in advance on a monthly or annual basis, depending on the billing cycle you selected at the time of purchase. All fees are stated in United States Dollars (USD).

We reserve the right to modify subscription pricing at any time. Any price changes will take effect at the start of your next billing cycle. We will provide at least 30 days’ notice of any price increase via email or in-app notification.

4. Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You shall not:

• [x] Use the Platform to engage in, facilitate, or promote any illegal activity, including money laundering, fraud, or market manipulation.
• [x] Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code, algorithms, or data models of the Platform.
• [x] Scrape, crawl, or use automated means to extract data from the Platform beyond what is permitted by your subscription plan’s API access.
• [x] Redistribute, resell, or sublicense any data, analytics, or forecasts obtained from the Platform without prior written consent.
• [x] Interfere with or disrupt the Platform’s infrastructure, including through denial-of-service attacks, injection attacks, or similar techniques.
• [x] Misrepresent PulseTerminal data or forecasts as financial advice, investment recommendations, or guaranteed outcomes when sharing with third parties.
• [x] Use the Platform to create a competing service or product.

5. Intellectual Property

All content, software, algorithms, data models, visual designs, trademarks, logos, and other intellectual property associated with PulseTerminal are and shall remain the exclusive property of PulseTerminal (pulseterminal.space) or its licensors. Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal or internal business use, subject to these Terms.

You retain ownership of any data you input into the Platform (such as custom watchlist configurations or portfolio data). By using the Platform, you grant us a limited license to process and store such data as necessary to provide the service.

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

No Financial Advice. Nothing on the Platform constitutes financial advice, investment advice, trading advice, or any other form of professional advice. All forecasts are probabilistic models based on historical data and market patterns; they do not predict the future and should not be relied upon as the basis for any investment decision. Cryptocurrency markets are highly volatile and speculative. You may lose some or all of your invested capital.

No Guaranteed Performance. We make no representations or warranties that any forecast, analysis, or signal provided by the Platform will be accurate, reliable, complete, or timely. Past performance of any analytics model does not guarantee future results.

We do not guarantee uninterrupted, error-free, or secure access to the Platform. Data feeds may be delayed, incomplete, or temporarily unavailable due to factors beyond our control.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PulseTerminal (pulseterminal.space), ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF INVESTMENT, OR FINANCIAL LOSSES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US IN SUBSCRIPTION FEES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

8. Indemnification

You agree to indemnify, defend, and hold harmless PulseTerminal (pulseterminal.space) and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any investment or trading decisions you make based on information obtained through the Platform.

9. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent or abusive behavior, non-payment of subscription fees, or if we determine that your continued use poses a risk to the Platform or its users.

You may terminate your account at any time by cancelling your subscription through the account settings page or by contacting our support team. Upon termination, your right to access paid features will cease at the end of your current billing period. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email to the address associated with your account or through a prominent notice on the Platform at least 30 days before they take effect. Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of those Terms. If you do not agree with any modification, you must stop using the Platform and cancel your subscription.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PulseTerminal (pulseterminal.space) is incorporated, without regard to its conflict of laws principles. Any dispute arising out of or in connection with these Terms shall first be submitted to good-faith mediation. If mediation is unsuccessful, the dispute shall be resolved by binding arbitration conducted in accordance with the rules of the applicable arbitration body in the jurisdiction of PulseTerminal (pulseterminal.space). You agree that any claim or cause of action arising out of or related to these Terms or the Platform must be filed within one (1) year after the cause of action arose, or be permanently barred.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

13. Entire Agreement

These Terms, together with the Privacy Policy, Billing Terms, and Risk Disclaimer, constitute the entire agreement between you and PulseTerminal (pulseterminal.space) with respect to your use of the Platform and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
